Spousal maintenance
Spousal maintenance is not just limited to married spouses. De facto partners can apply too.
Spousal maintenance is money paid by one party to support his/her former partner. This is different to Child Support which is money paid towards the reasonable expenses of a child.
Matters it can cover include; who pays for the home loan, household bills, credit card bills, and other similar ongoing liabilities.
Unlike Child Support, Spousal Maintenance is not automatic. Factors that will be taken into account include:
- The age and health of both parties.
- The respective incomes and financial resources of both parties.
- Care arrangements for, and the needs of, the children.
- What constitutes a suitable standard of living; and
- Whether either party is living with another person.
